This appeal presents the question whether the district court erred in finding that the plaintiff failed to prove, in a 42 U.S.C. § 1983 action, that a municipal supervisory employee violated plaintiffs First Amendment rights in refusing to issue a building permit. We hold that the district court properly concluded that the plaintiffs First Amendment rights were not abridged because the denial of the requested building permit was based upon the enforcement of a constitutionally valid zoning ordinance. We shall, therefore, affirm.
